Alan Ray Shennum appeals from an order of the District Court, Fourth Judicial District, Missoula County, committing and confining him to Warm Springs State Hospital for a period of three months.

We determine in this case that the state failed to follow the statutory safeguards imposed upon the state when it sought the commitment of the respondent on the charge of being seriously mentally ill, and that such failure mandates *445reversal in this case.
