In an action, inter alia, to recover damages for medical malpractice, the defendant Jagannath Singh appeals from an order of the Supreme Court, Kings County (Levine, J.), dated October 20, 2001, which denied his motion for summary judgment dismissing the complaint insofar as asserted against him.

Ordered that the order is modified, on the law, by deleting the provision thereof denying that branch of the motion which was for summary judgment dismissing the cause of action to recover damages for wrongful death insofar as asserted against the appellant, and substituting therefor a provision…
