CEDARBAUM, District Judge.

This is an action brought under 42 U.S.C. § 1983 and New York State law alleging false arrest and imprisonment, malicious prosecution and illegal wiretapping. The plaintiff, Anthony Merola, was a sergeant on the police force of the National Railroad Passenger Corporation (“Amtrak”). He seeks damages from defendants Amtrak; Ernest R.
