BUSSEY, Judge.

Gary L. Gaston, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Woodward County, with the crime of Possession of Marijuana, and from the judgment and sentence fixing his punishment at one year imprisonment in the State Penitentiary, he appeals.

Briefly stated, the pertinent facts are that at 8:00 p. m. on the 3rd day of February, 1968, two of the State’s witnesses observed the defendant in a black Cadillac, bearing California license plates at the Sonic Drive-In in Woodward, Oklahoma, and heard him talking to a young man about…
