MANTON, Circuit Judge.

Theodore M. Davis died at Newport, R. I., leaving a will, dated August 14, 1911, and a codicil, dated October 4, 1911, which were probated in the probate court of Rhode Island on April 5, 1915. Later, on May 24,1926, by a decree of the probate court of Rhode Island, a trust deed executed- upon the same day as his will was admitted to probate as a component part of the will. Merrill v.
