On August 29, 1985, a complaint was filed against Gary A. Vrtiska in the county court for Pawnee County and charged him with carrying a concealed weapon in violation of Neb. Rev. Stat. § 28-1202(1) (Reissue 1985). On September 1, the sheriff of Pawnee County and his deputy saw Vrtiska seated in a parked vehicle and, pursuant to the outstanding warrant, arrested Vrtiska. On searching Vrtiska and the automobile in which he was sitting, the officers discovered a .357 Magnum covered by a cloth in the car’s back seat and a revolver in Vrtiska’s left front pants pocket.
