ANDERSON, Justice.
Upon the premise that on July 3, 1950, appellant falsely imprisoned him, appellee, Kenneth C. Matthews, recovered judgment in the trial court against appellant, D. W. Hicks, for $10,000 as actual damages and $5,000 as exemplary damages. The judgment was based on a jury’s verdict.
Appellee predicated his suit on the alleged illegal and wrongful nature of the arrest itself, and also upon the theory that he was not accorded his legal right to be taken before a magistrate immediately after his arrest and given an opportunity to make bond.
