—Appeal from an order of Supreme Court, Erie County (Mintz, J.), entered March 8, 2002, which, inter alia, denied defendant’s motion for summary judgment dismissing the complaint.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.

Memorandum: Plaintiff was injured on March 10, 1998 when a vehicle crossed the center line of the roadway and struck another vehicle, which in turn struck the vehicle driven by plaintiff.
