— Reversing.
In September, 1913, appellant was building a new railroad yards at Irvine, in Estill county, Kentucky, *712the ground having been graded and leveled and the ties placed in position for putting down the rails. Appellee was a member of an extra gang, composed ordinarily of sixteen men, whose duties included carrying rails and “frogs” to where they were needed and placing them in position upon the ties. At the time of the accident complained of, plaintiff, with thirteen, at least, and possibly fifteen, other members of his gang, was carrying a steel…
