ORDER

BOYLE, Chief Judge.

This matter is before the Court on the Government’s Motion to Dismiss. The underlying action is a Petition for Habeas Corpus, filed pro se, pursuant to 28 U.S.C. § 2255. For the following reasons, Respondent’s motion is GRANTED and Kot-mair’s petition for habeas corpus is denied and dismissed.

BACKGROUND
