Batjer, J.:

In 1966 appellant plead guilty to a charge of felony drunk driving and was sentenced to a term of one to ten years in the state prison. The trial court suspended the sentence and granted probation for a period of five years.

In 1968 appellant was charged with violating the conditions of his probation. At the revocation hearing he claimed indigency and requested the appointment of counsel which was refused; however, the district court did instruct a member of the public defender’s staff to be present during the proceedings.
