—In an action to recover damages for personal injuries, etc., the plaintiffs appeal from an order of the Supreme Court, Westchester County (Ingrassia, J.), dated May 13, 1997, which granted the defendant’s motion for summary judgment dismissing the complaint.
Ordered that the order is modified, on the law, by deleting the provisions thereof which granted those branches of the defendant’s motion which were for summary judgment dismissing the first and third causes of action of the complaint, and substituting therefor provisions denying those branches of the motion; as so modified, the order is…
