OPINION

CORNELIUS, Chief Justice.

Collom & Carney Clinic Association and Mark E. Sutherland, M.D., Relators, have filed a petition for writ of mandamus to compel the Honorable William Peek, Judge of the 202nd Judicial District Court of Bowie County, to dismiss the underlying lawsuit. Relators are the remaining defendants in a medical malpractice lawsuit filed by Rosemary Moore, individually and on behalf of the Estate of Heather Moore, deceased, the real party in interest.
