This proceeding is in this Court pursuant to the certification procedure set forth in I.A.R. 12.11 (adopted April 3, 1981; effective July 1, 1981). The United States District Court for the District of Idaho has certified five questions to the Idaho Supreme Court as presenting controlling questions of Idaho law with respect to a pending federal case, Sunshine Mining Company v.
