Plaintiff, Phillip D. Hopgood, filed this diversity action for breach of contract and wrongful dismissal. The plaintiff alleges that he was unjustly dismissed from his position as a broker in violation of his employment contract. Defendant, Merrill Lynch, Pierce, Fenner and Smith, Inc. (hereinafter “Merrill Lynch”), contends that it dismissed the plaintiff for just cause and that their actions did not violate the employment contract.
