State v. Griffee

WOLLMAN, Justice.

This is an appeal from an order committing defendant to the State Penitentiary pursuant to an earlier judgment of conviction. We affirm.

On February 8, 1982, defendant pleaded guilty to a charge of sexual contact with a child under the age of fifteen years. SDCL 22-22-7. The trial court sentenced defendant to five years’ imprisonment in the State Penitentiary, “with said sentence being suspended until March 10,1983, with the Court to consider modification of sentence after February 1, 1983, and before March 10, 1983.” At the time the above described judgment was entered…
