Plaintiff, Jay Baier, appealed from the judgment of the circuit court of Cook County entered in favor of defendants, State Farm Insurance Company (hereafter defendant) and Allstate Insurance Company (hereafter Allstate), upon allowance of their separate motions for summary judgment. The appellate court affirmed the judgment in favor of Allstate, reversed and remanded as to defendant (28 Ill. App. 3d 917), and we allowed defendant’s petition for leave to appeal.
