The defendant appeals from a judgment in favor of the plaintiff entered upon an order granting plaintiff’s cross motion for summary judgment.
The facts are not in dispute. On August 7, 1951, the plaintiff was duly granted a license by the Board of Education of the City of New York to teach as a substitute teacher of common branch subjects in day elementary schools of the city. The license, as issued, stated it was “ Subject to passing the physical and medical examination ”.
