Ppon a former appeal in this action from a judgment entered upon the verdict of a jury, the judgment so entered was reversed and the case remanded for a new trial. Company A. v. Hughes, 49 N. D. 626, 193 N. W. 144. A new trial, in accordance with said mandate, was had in the district court of Burleigh county, before a jury, resulting in a verdict in favor of the plaintiff in the sum of <$6,500.
