I. P. Peeler, administrator of the estate of Jesse Nathan Mathis, deceased, brought this action in the Mc-Cracken Circuit Court against the appellee, seeking to recover of it for the wrongful death of his decedent under an Act of Congress known as the Jones Act, 46 U. 5. C. A., Section 688. It is alleged in the petition in substance that the deceased was employed as a deck hand upon the steam boat owned and operated by appellee, and while in the performance of his duties he fell from the boat into the Mississippi River and drowned.
