delivered the opinion of the court.
W. H. Lipscomb, a practicing physician, was indicted jointly with one Guy Jack, by the grand jury of Kemper county for the murder by poisoning of Charles T. Stewart, a patient of the accused. A severance was had and appellant was tried at the March term, 1897, of the circuit court of said county, and convicted of the crime. From this conviction he appealed to this court, and, on the nineteenth day of February, 1898, the judgment and sentence of death, passed upon him by the court below, was reversed and vacated and a new trial…
