This is a declaratory judgment action that was tried on an agreed statement of facts.

Plaintiff is the husband of Miriam Yankelevitz (Miriam). On October 10, 1976, Miriam was severely injured while riding as a passenger in an automobile operated by plaintiff. The automobile was owned by Novel Package Corporation (Novel), one of plaintiff’s employers. Defendant Royal Globe Insurance Company (Royal) is the primary insurance carrier, under a policy of insurance issued to Levon Products Inc. (Levon), plaintiff’s coemployer, wherein Novel, plaintiff and others…
