Currently pending before the Court is Plaintiffs/Counterclaim Defendant’s Motion for Summary Judgment (Doc. No. 33) and Suggestions in Support of Motion (Doc. No. 30).

I. Facts. 1

This action concerns a collision between a tractor trailer and an SUV on Highway 50 in Lee’s Summit, Missouri on September 16, 2005. {See Doc. No. 33, Plaintiffs Motion, ¶ 1).
