After a jury trial, Joseph R. Hughes was found guilty of felony malicious injury to property, I.C. § 18-7001 and the trial court entered an order withholding judgment and placing Hughes on probation. On appeal, Hughes asserts that the district court erred in allowing the State to impeach its own photographic evidence and in denying Hughes’s motion for a judgment of acquittal at the close of the State’s case because there was insufficient evidence to identify him as the perpetrator and…
