Court of Appeals for the Eighth Circuit

Decided February 23, 2005No. 04-2164PublishedCited by 26 opinions

1Opinion of the Court

HEANEY, Circuit Judge.

Following a jury trial, Shelbourne Sel-wyn was convicted of possession with intent to distribute methamphetamine or aiding and abetting possession with intent to distribute, in violation of 21 U.S.C. § 841(a)(1) and 18 U.S.C. § 2. The district court 1 sentenced Selwyn to 21 months of imprisonment with three years of supervised release. On appeal, Selwyn claims that the evidence was insufficient to support his conviction and further challenges the sentence imposed by the district court. We affirm the conviction, but remand for resentencing.
