Carr, J. :]This is an appeal from a judgment of the Municipal. Court in favor ■ of the plaintiff, against both defendants. The action was brought to recover for the value of the plaintiff’s services as a real estate agent in negotiating the sale of' real property. The contract upon which he sues was made between him and the defendent Arthur Burchell. Burchell claimed to own the property, and apparently acted as a principal in making the contract. Before this action was brought' the plaintiff. dis*17covered that the property in question was owned by Burchell's wife. Nevertheless he made both…
