The defendant Rhoda Eubanks is charged in an information with the crime of illegally obtaining unemployment insurance benefits, a violation of section 632 (subd 1, par [a]) of the Labor Law. The defendant has moved, on papers, to dismiss the charges in the interest of justice pursuant to CPL 170.30 (subd 1, par [g]) and 170.40.
