Proceeding pursuant to CPLR article 78 (initiated in this Court pursuant to CPLR 506 [b] [1]) to prohibit respondents from obtaining blood samples from petitioner.

On November 12, 1997, petitioner was indicted on two counts of murder in the second degree pursuant to Penal Law § 125. 25 (1) and (2) arising out of a homicide in the City of Albany on November 6, 1997. Specifically, petitioner was charged with causing the death of the victim by, inter alia, stabbing the victim.
