This appeal in a declaratory judgment action presents the issue of whether section 552.108(b)(1) of the Texas Public Information Act authorizes the City of Fort Worth to withhold from an individual seeking a position as a police officer background and reference information it obtains from third parties as part of its evaluation of his employment application. See Tex. Gov’t Code Ann. § 552.108(b)(1) (West Supp.2002). We hold that section 552.108(b)(1) does not permit the City to withhold such documents from a police officer applicant making a valid disclosure request…
