ORDER

HEMPHILL, District Judge.

This action was initiated on behalf of Jane D. as a class action, to secure rights under the National School Lunch Act, 42 U.S.C., §§ 1751, et seq., which plaintiffs allege had been violated by all defendants originally named in this action. Plaintiffs prayed for preliminary and permanent injunctive relief, as well as, for damages under 42 U.S.C. § 1983.
