CHESNUT, District Judge.
In this case the defendant, James David Evans, was indicted by the Grand Jury in three counts for (1) removing and concealing non-tax paid liquor; (2) possession of 31% gallons of non-tax paid liquor and (3) possession of that amount of liquor and 4,825 pounds of granulated sugar intended for use in violation of the federal liquor laws, namely 26 U.S.C.A. §§ 5601(a) (12); 5205(a) (2); 5604(a) (1) and 5686(a), on September 20, 1959 in a garage in the rear of 1522 Harlem Avenue, Baltimore, Maryland.
