for the Court.

The defendant, Robert Hesford, appeals from a judgment of conviction after a jury found him guilty of disorderly conduct and refusing to relinquish a telephone when he knew or should have known that it was needed for an emergency call. Because the defendant’s disorderly conduct conviction was his third domestic violence violation, see G.L.1956 § 12 — 29—5(c)(l)(ii), he was sentenced to ten years imprisonment, with eighteen months to serve in the Adult Correctional Institutions (ACI) and the remaining eight and a half years suspended, with probation.
