OPINION
GUADALUPE RIVERA, Justice.
These appeals arise from the trial court’s grant of Appellee and Cross-Appellant lone Grimm’s motion for summary judgment against Appellant and Cross-Appellee Gary Gonzalez. In two issues on appeal, Gonzalez contends that Grimm failed to prove each element of her immunity defense and that his controverting evidence created a fact issue. In her sole issue on appeal, Grimm contends that the trial court erred in failing to award her attorney’s fees and costs.
