In this action, the defendant is charged in a five count indictment with conspiring to defraud the United States by impeding the Internal Revenue Service in its function of computing defendant’s income taxes, 18 U.S.C. § 371, and with four counts of submitting false income tax returns for the years 1981, 1982,1983 and 1984. 26 U.S.C. § 7206(1).
