The appellant sues in replevin for a stock of goods unlawfully taken and detained by the respondent. The respondent • justifies the taking by the service thereon of several writs of attachment and. execution, as sheriff, in cases in favor of se'veral plaintiffs against one Armstrong *578as the owner of the goods, and pleads also the three-years statute of limitations according to sec. 4223, E. S., in bar of the action. The appellant’s demurrer to such answer in bar was overruled, and this appeal is from said order.
The only question, therefore, is whether the respondent can make said statute…
