OPINION

{¶ 1} Defendant, Dennis Gibson, appeals from a judgment of the trial court that denied a request Gibson made pursuant to the Federal Freedom of Information Act and the Ohio Public Records Act for documents pertaining to DNA testing performed in connection with a rape offense of which Gibson was convicted.

{¶ 2} On September 27, 2001, pursuant to a negotiated plea agreement, Defendant pled guilty to one count of rape in violation of R.C.2907.02(A)(2) and one count of gross sexual imposition in violation of R.C. 2907.05(A)(4). In exchange, the State dismissed two counts of rape in…
