The issues before the court are: (1) whether the debtor may claim an exemption in a common law arbitration award which was not reduced to judgment or paid into the state court until after the filing of the petition for relief by the debtor, (2) whether the debtor may avoid the lien of a creditor who has attached the arbitration award through garnishment proceedings, and (3) whether the debtor’s attorney, who helped obtain the arbitration award, is entitled to payment of his fees from the fund held by the state court prior to any distribution to the…
