TEMPLETON, Associate Justice.

The appellant, the city of Corsicana, is a municipal corporation, duly incorporated under the general laws of the State regulating the incorporation of cities and towns. It owns a sewer system, and one of the sewer mains is located underground in the center of North Fifteenth Street, one of the principal public streets of the city. The appellee L. M. Coates owned an unimproved lot fronting on said street, and in the summer of 1896 contracted with the appellees McCammon & Lang to build a house for him on said lot.
