Appeal by the plaintiff, Robert Adamson, as fire commissioner, etc., from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 30th day of June, 1914, sustaining a demurrer to the complaint, the hearing having been brought on as a contested motion.

The complaint, summarized, alleges that in November, 1912, the then fire commissioner of the city of New York, pursuant to the authority conferred upon him by section 775 of the Greater New York charter (Laws of 1901, chap. 466), as amended by chapter 899 of the Laws of 1911, made and served upon defendant, the owner of the building known as Nos. 212-214 East Ninety-ninth street in the city of New York, an order that said building be equipped with a system of automatic sprinklers; that said defendant failed and omitted to comply with said order and to equip said premises with the…
