Appeal by the plaintiff, The City of New York, from a judgment of the Supreme Court in favor of the defendants, entered in the office of the clerk of the county of New York on the 29th day of October, 1908, upon the dismissal .Of the complaint by direction of the court at the close, of the plaintiff’s case, on a trial at the New York Trial Term, and also from an order entered in said clerk’s office on the 28th day of October, 1908, directing the dismissal of the complaint.

In this action the city of New York seeks to recover from -the defendants the amount which the city was obliged to pay to one William J. Parks,-as administrator,' etc., of Erwin- L. Coólidgej deceased, for the damages resulting, from the death of said Coolidge. The defendant Henry Corn was, in 1902, the owner of a lot'of land on the northwest, corner of Fifth avenue, and Eighteenth street in the borough of Manhattan, city of New York, upon which he proposed to erect a large building.
