Dawson, J.:

This was an action by a husband against his wife, in which he charged her with adultery, and the relief prayed for was a divorce and the custody of their five-year-old daughter.

The trial court found the woman guilty of adultery, but that it was committed “with the knowledge, connivance and consent of the plaintiff,” and denied the divorce. Until the further order of the court, the child was entrusted to the- care of its mother, except that the father should have its custody three months each year in vacation time.
