In a proceeding pursuant to CPLR article 75, inter alia, to permanently stay arbitration of an uninsured motorist claim, the petitioner appeals, as limited by its brief, from so much of an order and judgment (one paper) of the Supreme Court, Richmond County (Sangiorgio, J.), dated April 26, 1989, as, without a hearing, denied that branch of its petition which was to permanently stay arbitration.

Ordered that the order and judgment is reversed insofar as appealed from, on the law, with costs, the petition is granted and the arbitration is permanently stayed.
