I. INTRODUCTION

This matter is before the court on defendant’s Motion to Dismiss (Doc. 18) and plain tiffs Motion for Temporary Restraining Order, Preliminary Injunction, Expedited Hearing and Waiver of Security (Doc. 4).

II. PROCEDURAL BACKGROUND

On January 22,1990, and January 31,1990, respectively, Willie Brown filed concurrent applications for Title XVI Supplemental Security Income (SSI) and Title II disability benefits.
