ONION, Presiding Judge.

On this the 19th day of July, A. D., 1978 came on to be heard the application for writ of habeas corpus by petitioners Cecil Bain and Thomas M. Thurmond. Petitioners, who are San Antonio attorneys, contend they are being unlawfully restrained of their liberty by the respondent, Judge John G. Benavides, Judge of the 187th District Court of Bexar County, who has “designated” and ordered them subject to contempt proceedings, to represent one James Buff-ington in a capital murder case, without being retained by Buffington or appointed by the court to represent the…
