MEMORANDUM OF DECISION

This matter came before the Court on the MOTION FOR RELIEF FROM STAY filed by Southtrust Bank, as agent for First Bank of Alabaster (hereinafter collectively referred to as “the Bank”). The Bank has also filed a MOTION FOR SUMMARY JUDGMENT. Rule 56 of the Federal Rules of Civil Procedure is made applicable to adversary proceedings by Rule 7056 of the Bankruptcy Rules.
