Reversing.
The appellant and defendant below, Lindsay Batts, at the time of the transactions here involved, and prior thereto, was the owner of an improved farm in Shelby county, Ky., containing about 175 acres.' It was in a high state of cultivation and was employed by defendant for agricultural purposes and also for the operation of a dairy business to a limited extent.
