The defendant, for a considerable time, had been suffering from the depredations of thieves. Plaintiff was a detective of 20 years’ experience, employed in that capacity by the Lake Shore Railway Company, said employment having extended over a period of 5 years. Somerville heard of the losses the Wabash Company was suffering, and went to the company’s local freight agent, one Tozer, and offered his services in securing the apprehension and arrest of the thieves.
