McGRAW, Chief Justice:

Nelson Clark Ashcraft appeals from a final order of the Circuit Court of Ritchie County entered August 17, 1981, which confirmed his conviction for first degree murder, denied his motion for a new trial, and sentenced him to life in the penitentiary, subject to the jury’s recommendation of mercy.
