The appellant, Charles W. Peacher, Jr., was convicted of the crime of murder in the first degree of Rowlen E. Moreland, a former sheriff of Jefferson County. The case is before this Court on an appeal from a final order of the Circuit Court of Jefferson County, entered on June 6,1977, sentencing the defendant to life imprisonment in the West Virginia Penitentiary without parole, and denying the defendant’s motion to set aside the verdict and award him a new trial.
