NANCY F. ATLAS, District Judge.

Virgilio Maldonado (“Maldonado”), a Texas inmate incarcerated under a sentence of death, petitions for habeas corpus relief. (Doc. # 1). A jury convicted Maldonado for committing the capital murder of Cruz C. Saucedo during a robbery. After a separate punishment hearing, the same jury answered Texas’ special issue questions in a manner requiring the imposition of a death sentence.
